Appropriate Use Policy

This Appropriate Use Policy ("AUP") sets forth conditions of use of the services of IPflea.com (the "Provider" or "IPflea"). Because proxy usage can vary, this AUP is intended to guide customers ("Customer") in their use of IPflea's services ("Service" or "Services") and is not, and cannot be, all-encompassing. The examples below illustrate violations of this AUP, but other actions or uses may also constitute violations if they contravene the spirit or letter of this policy.

1. Copyright and Other Proprietary Right Infringement

Customers shall not use IPflea's Services to infringe upon copyrights, patents, or other intellectual property rights or proprietary materials of third parties. This includes, without limitation, activities prohibited under any relevant laws, whether international, federal, state, or local (e.g., the U.S. Digital Millennium Copyright Act).

2. Spamming

Customers shall not engage in "spamming," which includes sending bulk, unsolicited materials via IPflea's Services. This prohibition extends to all media or modes of communication, including but not limited to email, social network messages, blog comments, and forum spam.

3. Illegal Activities

Customers shall not use IPflea's Services to partake in or facilitate illegal activities of any kind, including but not limited to:

  • Terroristic threats or threats of harm
  • Multi-level marketing or "Ponzi" schemes
  • Credit card fraud or identity theft
  • Racketeering, slander, defamation, or any other unlawful conduct

4. Child Pornography

Customers shall not use IPflea's Services to view, promote, distribute, or engage in any activity related to child pornography or exploitation. This strictly violates relevant laws such as the Child Online Protection Act, Communications Decency Act of 1996, and the Children's Internet Protection Act.

5. Threats and Harassment

Customers shall not make threats or harass any individual, organization, or business via IPflea's Services.

6. Fraudulent Activities

Customers shall not engage in fraud or any other form of misrepresentation while using IPflea's Services.

7. Denial of Service

Customers shall not originate, control, or participate in denial-of-service or distributed denial-of-service attacks or any similar disruptive activities using IPflea's Services.

8. Hacking

Customers shall not gain or attempt to gain unauthorized access to any network or system (including, without limitation, computers, telephony systems, or data storage systems) while using IPflea's Services.

9. Distribution of Malware

Customers shall not create, distribute, or use malicious software (malware), including but not limited to viruses, rootkits, password crackers, spyware, or keystroke loggers.

10. Phishing

Customers shall not engage in phishing or similar activities designed to collect personal information (e.g., names, account numbers, usernames, passwords) via IPflea's Services.

11. Fraudulent Financial or Ponzi Schemes

Customers shall not promote, offer, or sell interests in illegal financial schemes, including Ponzi schemes, while using IPflea's Services.

12. Bullying

Customers shall not engage in bullying of any individual, organization, or entity using IPflea's Services.

13. Stalking

Customers shall not use IPflea's Services to stalk or otherwise harass individuals, organizations, or entities.

14. Derogatory or Defamatory Remarks or Conduct

Customers shall not use IPflea's Services to disseminate material or engage in conduct that is malicious, hateful, defamatory, or abusive.

15. Impersonation

Customers shall not impersonate another individual (living or deceased), entity, or organization without explicit authorization.

16. Violations Alleged by Third Parties

IPflea may receive reports from third parties of alleged violations of this AUP. IPflea will, at its sole discretion, review such reports and take appropriate action, which may include suspension or termination of the Customer's account or Services.

17. Violation of Laws

Customers shall not use IPflea's Services for any activity that violates local, state, national, or international laws or regulations.

18. Attempted Access to Certain Websites

Customers are informed that they may be restricted from accessing certain websites through IPflea's Services. Any attempt to circumvent these restrictions is a violation of this AUP.

19. Use of Prohibited Software

Certain software applications are incompatible or prohibited with IPflea's Services. Customers shall not use such applications in conjunction with IPflea's Services.

Method of Resolution for Alleged Violations

  • Notification & Response: Upon discovering an alleged violation of this AUP, IPflea will generally notify the Customer and provide a specified timeframe for the Customer to respond.
  • Lack of Response: If the Customer fails to respond, IPflea may suspend or terminate the Customer's account without further notice and without refund, as permitted by IPflea's Terms of Service ("TOS").
  • Determination of Violation: If, after reviewing the Customer's response, IPflea determines that a violation has occurred, IPflea may immediately terminate or suspend services to the Customer without further notice or refund.

Security of Customer Information

IPflea cannot guarantee that data or information stored or transmitted through IPflea's Services will be immune from unauthorized access. The Customer agrees to hold IPflea harmless for any such unauthorized access or security breaches, in accordance with IPflea's TOS.

Monitoring Customer's Use of Services

IPflea may, at its sole discretion, monitor Customer's use of IPflea's Services to:

  • Investigate potential violations of this AUP.
  • Protect or enforce IPflea's rights under the TOS or this AUP.

Disclosure Pursuant to Subpoena

IPflea may be legally required to disclose Customer information in response to a subpoena or other governmental, administrative, or legal request. When permitted by law, IPflea may, but is not obligated to, provide notice to the Customer before disclosure.

Data Collection and Retention

IPflea collects and maintains logs related to Customer's use of IPflea's Services, including websites visited, payment information, and other relevant data. These logs are typically maintained for approximately 60 days and may be kept longer at IPflea's sole discretion.

Right to Decline or Terminate Service

IPflea reserves the right, at its sole discretion, to refuse Services to any prospective or existing Customer, including declining to provide additional Services or renewals.

Incorporation of Terms of Service

IPflea's Terms of Service ("TOS") is incorporated by reference and forms an integral part of this AUP. Any breach of this AUP is considered a breach of the TOS. Customers should review the TOS at IPflea.com/terms-of-service for more information.

Changes to this AUP

IPflea may change this AUP at any time, at its sole discretion, without notice. Customers are responsible for reviewing the AUP periodically on IPflea.com for updates. Continued use of IPflea's Services following any changes to this AUP constitutes acceptance of those changes.

Breach

Any breach of this AUP constitutes a breach of the TOS. IPflea may immediately terminate the Customer's Services, without notice or refund, at its sole discretion, upon any such breach.

Severability

If any term or provision of this AUP is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

Headings

Section headings are included solely for convenience and do not affect the meaning or interpretation of this AUP.

Gender / Number

All references in this AUP to any gender or number (singular/plural) are deemed to apply equally to all genders and both the singular and plural forms, as the context may require.
