By accessing or using any service offered by IPflea.com ("IPflea"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Agreement"). IPflea reserves the right to update this Agreement at any time without prior notice. Your continued use of the services constitutes acceptance of any modifications.

1. Description of Service and Membership Guidelines

IPflea provides users ("Members") with the ability to privately retrieve information from third-party websites on the World Wide Web, among other benefits. In exchange for these services, IPflea may charge Members a subscription or other fee(s).

• Eligibility: Members must be at least 18 years old or have the explicit permission of a parent or guardian, and be competent to enter into a binding contract.
• Accuracy of Information: Members must provide current, complete, and accurate personal information when registering for the service and maintain this information accordingly.

2. Member Account, Password, and Security

To open an account with IPflea, you must complete the registration process and successfully fulfill any required payment authorization. You are solely responsible for:

• Maintaining the confidentiality of your password and account.
• All activities that occur under your account.
• Immediately notifying IPflea of any unauthorized use of your account or any other security breaches.

3. Member Privacy

It is IPflea's policy to respect the privacy of its Members. IPflea will not monitor, edit, or disclose any personal information about you or your use of the service (including its contents) without your prior permission, unless IPflea has reason to believe such action is necessary to:

• Comply with legal requirements or legal processes.
• Protect and defend the rights or property of IPflea.
• Enforce this Agreement.
• Protect the interests of other users or individuals.

4. Member Conduct

As a condition of using IPflea's services, you agree not to use the service for any unlawful or prohibited purpose. This includes, but is not limited to:

• Unauthorized Content: You warrant that you either own or have been granted the necessary rights to any content you access or transmit, and that your use of such content does not infringe on any third-party rights.
• Prohibited Use: You agree not to use IPflea's services for commercial resale, chain letters, junk email, spamming, harassment, stalking, distributing unlawful material, or any other activity that violates applicable laws or regulations.
• No Malicious Activities: You must not transmit or upload any material that contains viruses, worms, or other harmful software, nor attempt to gain unauthorized access to IPflea's systems, other user accounts, or third-party networks.

You acknowledge that IPflea has no obligation to monitor your use of the service, but reserves the right to do so to comply with legal obligations or protect IPflea's rights and those of its users.

5. Personal and Noncommercial Use Limitation

Unless expressly permitted by IPflea or applicable law, you may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any materials, information, or software obtained from IPflea's services. You agree to abide by all applicable local, state, national, and international laws and regulations. You must not:

• Overburden or impair any IPflea site or service.
• Interfere with others' use and enjoyment of IPflea's services.
• Attempt to gain unauthorized access to IPflea services, other accounts, or any related networks.

6. Third-Party Content

IPflea is not responsible for any content accessed on third-party websites. Any such content accessed via IPflea's services is provided "as is," and IPflea does not endorse or assume any liability for such content or its operators.

7. Disclaimers / Limitation of Liability

Use of IPflea's services is at your own risk. IPflea makes no warranties, whether express or implied, regarding the reliability, accuracy, or availability of its services.

• Service "As Is": IPflea's services and any information obtained through the service are provided "as is," without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement.
• No Liability: IPflea is not liable for any direct, indirect, punitive, incidental, special, consequential, or other damages arising out of or related to the use or inability to use its services.
• Customer Responsibility: Each customer is solely responsible for all usage and actions taken while using IPflea services. IPflea is not responsible for any third-party interventions or legal violations committed by users.

Because some jurisdictions do not allow the exclusion or limitation of certain damages, some of these limitations may not apply to you. In such cases, liability is limited to the fullest extent permitted by law.

8. Indemnification

You agree to indemnify and hold IPflea, its affiliates, officers, employees, and agents harmless from any claim, demand, or damage, including reasonable attorneys' fees, arising out of or related to your use of or conduct on the service.

9. Termination

IPflea may terminate or suspend your access to the service at any time, with or without cause or notice. Reasons for termination may include, but are not limited to:

• Violation of this Agreement.
• Prolonged inactivity.
• Unauthorized or suspicious account activity.

Upon termination, your right to use the service immediately ceases. IPflea is not obligated to maintain any content in your account or forward unread or unsent messages to you or any third party.

10. No Spam – Damages

IPflea will terminate any account believed to be transmitting spam or other unsolicited bulk emails. In situations where actual damages are difficult to calculate, you agree to pay IPflea liquidated damages of USD $10 for each spam email or unsolicited bulk email transmitted from or otherwise connected with your account, unless IPflea chooses to pursue the actual damages.

11. Proprietary Rights to Content

All content, including but not limited to text, software, photographs, video, music, and graphics presented by IPflea or third-party advertisers, is protected by intellectual property laws. You may not copy, reproduce, republish, upload, post, or distribute any of this content without the owner's explicit permission, except as expressly authorized by law.

12. Modifications to Terms of Service

IPflea reserves the right to change these Terms & Conditions or any policy related to the use of the service at any time. Such updates will be posted on the website, and it is your responsibility to review the Agreement periodically. Continued use of the service after any changes constitutes your consent to such changes.

13. Refunds

For details on refunds, please refer to IPflea's Refund Policy, which governs the conditions and processes for obtaining a refund. In general, if you experience technical difficulties, contact our support team at support@IPflea.com for assistance before requesting a refund.

14. Location

Our system may use third-party databases (e.g., MaxMind) to determine the IP location. A location mismatch may occur if other databases are not yet updated. You can check the IP location via www.maxmind.com/en/geoip-demo.

15. General

• Governing Law: This Agreement is governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
• Jurisdiction: You agree that any legal action arising from this Agreement will be brought in the state or federal courts located in Wilmington, Delaware.
• Time Limitation: Any cause of action must commence within one (1) year after the claim or cause of action arises.
• No Relationship: No joint venture, partnership, employment, or agency relationship exists between you and IPflea as a result of this Agreement.
• Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in effect.
• Entire Agreement: This Agreement, alongside any posted guidelines or rules, constitutes the entire agreement between you and IPflea regarding your use of the service, superseding any prior or contemporaneous communications.
